Land transfer tax has existed in Ontario since 1921. In those days, however, the tax was relatively insignificant. In April 1974, the old Land Transfer Tax Act (LTTA) was dropped and a new, much more complicated, land transfer tax came into force bringing with it a 20% tax on non-resident purchase transactions.

The Land Transfer Tax Act has been amended on a number of occasions since then, most recently in May 1997. When the Land Transfer Tax Act was introduced in 1974, it included a surcharge provision to be applied to the acquisition of land by foreign investors. This surtax was eliminated in 1997; however non-resident corporations with land holdings may be subject to tax deferrals.

Currently, the land transfer tax in Ontario is as follows:
0.5% - on the first $55,000
1.0% - on portion between $ 55,000 - 250,000
1.5% - on balance over $250,000

In addition to the general tax rates, if the land falls under the definition of single family residence, there is an additional tax of .05% of the value of the consideration over $400,000

Ontario Land Transfer Tax $

This is a tax charged by the province when ownership of property is changed. It is normally paid by the purchaser when property is bought. You should check with your lawyer whenever you are considering any changes to title of real estate property (including adding spouses or children).
